Este JUZGADO PRIMERO DE PRIMERA INSTANCIA EN LO CIVIL, MERCANTIL, TRÁNSITO Y MARÍTIMO DE LA CIRCUNSCRIPCIÓN JUDICIAL DEL ESTADO ZULIA, administrando justicia en nombre de la República Bolivariana de Venezuela y por autoridad de la Ley, actuando de conformidad con lo establecido en el artículo 242 del Código de Procedimiento Civil, declara: PRIMERO: IMPROCEDENTE la defensa perentoria de falta de cualidad activa y pasiva, opuesta por la representación judicial de la parte demandada, Sociedad Mercantil ALIMENTOS FÉNIX DE VENEZUELA, C.A. SEGUNDO: CON LUGAR la demanda que por INCUMPLIMIENTO DE CONTRATO Y EJECUCIÓN DE LA CLÁUSULA PENAL DE INDEMNIZACIÓN DE DAÑOS Y PERJUICIOS, sigue la Sociedad Mercantil REPRODUCCIÓN ANIMAL E INSEMINACIÓN ARTIFICIAL, C.A., contra la Sociedad Mercantil ALIMENTOS FÉNIX DE VENEZUELA, C.A., identificadas en actas. TERCERO: Se declaran RESUELTOS los contratos vinculados celebrados entre las Sociedades Mercantiles REPRODUCCIÓN ANIMAL E INSEMINACIÓN ARTIFICIAL.....
