Por los fundamentos expuestos, este JUZGADO SUPERIOR SEGUNDO EN LO CIVIL, MERCANTIL Y DEL TRÁNSITO DE LA CIRCUNSCRIPCIÓN JUDICIAL DEL ESTADO ZULIA, administrando justicia en nombre de la República Bolivariana de Venezuela y por autoridad de la Ley, en el juicio de CUMPLIMIENTO DE CONTRATO incoado por las ciudadanas RUBY ABIGAILA MENDEZ LABARCA y NEVYT ROOTH MENDEZ LABARCA en contra de la Sociedad Mercantil CONSTRUCTORA SIGLO XXI, C.A., declara: PRIMERO: SIN LUGAR el recurso de apelación interpuesto por la Sociedad Mercantil CONSTRUCTORA SIGLO XXI, C.A., por intermedio de su apoderado judicial MARCELO MARIN HIDALGO, contra sentencia de fecha 30 de abril de 2012, dictada por el JUZGADO PRIMERO DE PRIMERA INSTANCIA EN LO CIVIL, MERCANTIL Y DEL TRÁNSITO DE LA CIRCUNSCRIPCIÓN JUDICIAL DEL ESTADO ZULIA. SEGUNDO: SE CONFIRMA la aludida decisión de fecha 30 de abril de 2012, proferida por el Juzgado a-quo, en el sentido de declarar CON LUGAR la demanda de CUMPLIMIENTO DE CONTRATO incoad.....
